What Legal Options Do Families Have After a Fatal FedEx Truck Accident in Hanover Township, PA?
After a fatal truck accident, surviving family members may be able to file a wrongful death claim. This may provide compensation for funeral and burial expenses, lost financial support, and other losses related to the death. A wrongful death claim focuses on the family’s losses.
Under Pennsylvania law, families may also pursue a survival action. This type of claim addresses losses the deceased person experienced before death, including medical expenses, lost wages, and pain and suffering. These damages are generally pursued through the deceased person’s estate.
When a commercial truck is involved, responsibility may extend beyond the driver. A trucking company, contractor, or another party may share responsibility for the crash. Identifying each responsible party can help determine what compensation may apply.
Once the investigation begins, preserving evidence can help determine how the collision occurred. Truck data, driver logs, maintenance records, photographs, available video, and investigative findings may help establish what happened and who may be responsible.
In most cases, Pennsylvania gives families two years from the date of death to file a wrongful death claim. Because missing the applicable deadline can affect your family’s ability to recover compensation, it is important to determine which time limits apply.
